EU global human rights sanctions regime: is the genie out of the bottle?

On 7 December 2020, the EU Foreign Affairs Council adopted an ‘EU Global Human Rights Sanctions Regime’ (EU HRSR). The HRSR is example of a transnational response to fundamental security-related challenge. Both its adoption and specific institutional set-up are continuation move towards stronger supranational practices in area sanctions. Further supranationalising EU’s sanctioning practices, as one most developed powerful tools security threats, likely increase uniformity, flexibility, arguably also impartiality At same time, process demonstrated that national governments set limits further supranationalisation. While particular Dutch parliament was driving force behind HRSR, both parliaments European Parliament struggle have significant influence over process. Yet, much depends on actual legal framing HRSR’s objectives, designation criteria evidentiary threshold may practice raise legitimacy problems.
